1. Acceptance of Terms

By accessing or using the HeatIntelAI Heat Treatment Advisor website and services (“Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree with any part of these Terms, you must not use the Service. These Terms apply to all visitors, registered users, and any other individuals who access or use the Service.

2. Service Description

HeatIntelAI provides AI-powered heat treatment advisory services designed to assist engineers, metallurgists, and related professionals in obtaining heat treatment process recommendations for metallic components. The Service generates recommendations using artificial intelligence models trained on metallurgical data, standards, and engineering references.

3. AI-Generated Content Disclaimer

The Service uses artificial intelligence and machine learning models to generate heat treatment recommendations. You acknowledge and agree that:

• AI models may produce inaccurate, incomplete, or outdated recommendations. The technology is continually improving but is not infallible.
• The Service does not replace the advice, review, or sign-off of a qualified, licensed metallurgist, materials engineer, or relevant certified professional.
• All recommendations must be reviewed and validated by qualified personnel before implementation in any production, manufacturing, or safety-critical process.
• Heat treatment processes carry inherent risks including, but not limited to, material damage, dimensional distortion, cracking, residual stress, and equipment hazards.

5. User Responsibilities

As a user of the Service, you agree to:

• Use recommendations as advisory guidance only, not as definitive professional specifications or certified engineering documents
• Have all recommendations independently reviewed by qualified engineering or metallurgical professionals before implementation
• Comply with all applicable local, national, and international laws, regulations, and industry standards in your jurisdiction
• Not use the Service for any unlawful, fraudulent, or harmful purpose
• Maintain the confidentiality and security of your account credentials
• Only upload drawings and technical documents for which you hold appropriate rights or authorisation

6. Professional Standards Compliance

Heat treatment recommendations may reference industry standards such as ASTM, AMS, ISO, IS (Indian Standards), DIN, JIS, and others. The user is solely responsible for ensuring compliance with the applicable standards and regulations in their jurisdiction. HeatIntelAI does not warrant that any recommendation meets any specific regulatory, quality, or safety requirement. Final process specifications must be certified by qualified personnel as required by your industry or regulatory framework.

7. Payment and Refund Policy

• All payments are processed securely through Razorpay. HeatIntelAI does not store payment card details.
• Plan subscriptions are billed monthly. Credits are one-time purchases and do not expire.
• Plan subscriptions and credit purchases are non-refundable once activated or consumed.
• In exceptional circumstances, partial refunds for unused credits may be considered at HeatIntelAI's sole discretion. Contact us with your order details.
• Razorpay charges are made in INR. Displayed prices in other currencies are indicative only.

8. Account and Access

You are responsible for maintaining the confidentiality of your account. HeatIntelAI reserves the right to suspend or terminate any account that violates these Terms, engages in misuse of the Service, or poses a risk to other users or the platform, without prior notice or liability.

9. Intellectual Property

All content, trademarks, logos, software, and materials on the Service are owned by or licensed to HeatIntelAI. You may not reproduce, distribute, or create derivative works without express written permission. Technical data you submit remains your property. By submitting data, you grant HeatIntelAI a non-exclusive, royalty-free licence to use it solely for providing and improving the Service.

10. Data Collection and Privacy

We collect and process the following personal data to provide the Service:

• Account data: Email address, country of registration
• Usage data: Query history, mode used, usage counts, and timestamps
• Technical data: IP address (used for geo-detection and security)
• Uploaded drawings: Processed in real-time for analysis; not stored persistently beyond your session
• Payment data: Order IDs and payment confirmation (card details are handled entirely by Razorpay)

We implement reasonable technical and organisational security measures to protect your data from unauthorised access, disclosure, or misuse.

11. Data Sharing Policy

We do not sell, rent, or trade your personal data to any third parties. We share data only as necessary to deliver the Service:

• Anthropic:Your query prompts (not personally identifying information) are sent to Anthropic's Claude API for AI processing. Anthropic's own privacy policy governs this processing.
• Razorpay: Payment details are processed by Razorpay under their privacy policy and PCI-DSS standards.
• Supabase:Encrypted data is stored on Supabase's infrastructure under their privacy policy.
• IP Geolocation: Your IP address is briefly sent to a geolocation service solely to detect your country for currency display. No query data is shared.

We do not share your data with advertising networks, analytics resellers, or any other third parties beyond those listed above.

12. Data Retention

• Usage logs and query history are retained for up to 12 months and then deleted.
• Payment records are retained for 7 years as required by applicable tax and financial regulations.
• Uploaded drawings are processed in-session and are not stored persistently on our servers.
• Account data is retained for as long as your account remains active. Upon account deletion, personal data is removed within 30 days subject to legal retention requirements.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in India. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
